Over two hundred years after Immanuel Kant’s death, the first full, critical, and digital edition of his last manuscript is currently being completed by the Berlin-Brandenburgische Akademie der Wissenschaften. This edition stands in institutional continuity with Wilhelm Dilthey’s monumental Akademieausgabe of Kant’s writings that was grounded in Dilthey’s lastingly influential concept of the national, literary-philosophical archive. The new edition showcases Kant’s dynamic writing process as a matter of investigation in its own right. As I argue here, it brings into view (...) the constitutive role of the archive for both texts and interpretative practices. A historical perspective that links the legacy of the Akademieausgabe with the digital edition of the Opus postumum highlights the changing role of the archive in emphasising or de-emphasising the manuscript’s resistance to certain appropriations and stylisations of Kant as a thinker. There are few doubts about the significance of science and technology for modern human culture and society. But as historians, we are still struggling to find appropriate descriptive terms to capture the broad processes of transformation brought about by “techno-science,” the merging of technical production and modern institutionalized science. This dissertation argues that the term “experience” may serve as such an analytic lens in the specific historical setting of German aviation research from the 1920s through 1945. I reconstruct, on the (...) one hand, the theorization of experience as a concept by the technical physicist Paul von Handel, influenced by the British astronomer Sir Arthur Eddington’s distinction between "scientific" and "everyday" experience. On the other hand, I use the term as a historian’s analytic concept to investigate practices in the context of flight experiments that I take to be constitutive of my historical actors’ experiences. These are recordings of experimental pilots’ cognitive judgements and bodily actions, some of them—such as in-flight note taking—continuous with older cultural technologies. On both of these levels of analysis, I explore the different resonances of “experience” as a term with a legacy as a central epistemological concept in the modern sciences, and as capturing the changing everyday reality in an increasingly technicized environment. My analysis of the textual theorization and simultaneous practical constitution of "techno-scientific experience" serves to read in a new light the story of the pilot and physicist Melitta Schiller-Stauffenberg. Of Jewish descent, Schiller chose to work for the Luftwaffe, the German air force, until her death in 1945 on a flight searching for her husband, Count Alexander Stauffenberg, who was imprisoned after his brother’s failed attempt to assassinate Hitler. The concept and practical reality of “experience” are key to understanding the two striking choices Schiller made as intrinsically connected: the professional choice of working simultaneously as a pilot and a physicist, and the political choice of supporting the Reich’s war effort. Schiller’s story may be understood as exemplifying the fragile identity of the experiencing and the knowing self in 20th-century techno-scientific modernity. (shrink)

In this commentary we challenge Fitouchi et al.'s puritanical morality account by presenting evidence showing (1) that pursuing harmless pleasures can actually support self-regulation, and (2) that sharing pleasurable experiences can foster cooperation. We conclude that puritanical morality is not as adaptive as presented, and may even suppress the potential benefits pleasure can have for the individual and society.

ZusammenfassungDer Beitrag baut auf Niklas Luhmanns Unterscheidung zwischen verschiedenen Typen sozialer Systeme auf, nämlich Interaktionen, Organisationen und einer durch funktionale Teilsysteme strukturierten Gesellschaft. Auf dieser Basis wird der Fall zweier Schüler in einer Schweizer Sekundarschule analysiert, die ihren Lehrerinnen mit religiöser Begründung den Handschlag verweigerten. Gezeigt wird, wie dieses Ereignis von verschiedenen Systemtypen als Problem bearbeitet und jeweils unterschiedlich beobachtet wurde, wobei speziell auch die Frage nach dem Stellenwert des Teilsystems Religion gestellt wird. Insbesondere der Zeitbedarf und der Stellenwert schriftlicher (...) Kommunikation der verschiedenen Systeme erweisen sich als Faktoren, über die sich die unterschiedliche Rolle verschiedener Systemtypen in der Affäre verstehen lässt. Religion beeinflusste zunächst zwar die Interaktion im Klassenzimmer, schließlich fungierte sie aber eher als Thema von Recht, Politik und Massenmedien, als dass sich religiöse Kommunikation über den ursprünglichen Interaktionszusammenhang hinaus als einflussreich erwiesen hätte. ZusammenfassungÖkonomische Rahmenbedingungen der klinischen Tätigkeit bringen die Ärzteschaft häufig in Konflikte zwischen ihrem Berufsethos und den wirtschaftlichen Zielen der Klinik. Nicht selten werden diese Konflikte zwischen der Ärzteschaft und dem nicht-klinischen Krankenhausmanagement ausgetragen. Obwohl sowohl medizinische als auch ökonomische Ziele relevant sind, um eine ineffiziente Verteilung finanzieller Ressourcen im Gesundheitswesen zu vermeiden, gibt es großes Konfliktpotenzial. Insbesondere die klinische Ärzteschaft steht in der Verantwortung, einen adäquaten Umgang mit den ökonomisch-ethischen Konfliktpotentialen zu erlernen. Denn von ihnen wird erwartet, das ärztliche Ethos (...) zu bewahren, wirtschaftliche Forderungen nicht unkritisch zu übernehmen sowie eine qualitativ hochwertige Patientenversorgung zu gewährleisten. Inwiefern der Umgang mit den Konflikten und deren Auswirkungen auf die Zusammenarbeit zwischen Ärzteschaft und Krankenhausmanagement in der medizinischen Lehre eine Rolle spielt bzw. spielen sollte, wird in der vorliegenden Forschungsarbeit mittels der Analyse der medizinischen Curricula, nationaler und internationaler Publikationen, eines Modellprojektes sowie Experteninterviews untersucht. Anhand dieser Untersuchungen konnte herausgearbeitet werden, dass jene Inhalte vor allem in den Querschnittsbereichen 2 „Geschichte, Theorie und Ethik der Medizin“ und 3 „Gesundheitsökonomie, Gesundheitssystem, Öffentliches Gesundheitswesen“ des Medizinstudiums gelehrt werden. Da diese Lehre von den Hochschulen frei gestaltbar ist, besteht diesbezüglich jedoch eine hohe Heterogenität. Insbesondere die Ergebnisse der Interviews bestätigen die Relevanz einer Integration dieser Inhalte ins Medizinstudium und die Chance, dadurch den Umgang der Ärzteschaft mit den ethischen Konfliktsituationen zu Gunsten der Patientenversorgung zu verbessern. Zudem besteht die Möglichkeit, die Inhalte in interprofessioneller Form zu lehren und dadurch das gegenseitige Verständnis und die Zusammenarbeit der klinischen Ärzteschaft mit dem Krankenhausmanagement zu stärken. In recent years a debate has raged in American political science and philosophy about the validity of the hypothesis that the growth in the number of states with liberal-democratic polities will lead to a more stable and harmonious international order. This article travels down the path of democratic peace not with the present preoccupations in mind but rather with the intention of deciding what the argument looks like from Kant's and a Kantian perspective. In the literature on democratic peace Kant (...) has been much referred to: it is true to say that he has become an emblem of the thesis. This is so to such an extent that authors need only cite Kant to show that they are engaging with the debate. The treatment of Kant in such articles tends to be quite cursory. Here I want to alter this emphasis by attempting to measure the democratic peace thesis by Kant's standards. There are intriguing differences of emphasis between current international liberal peace theorists and Kant's original argument which tell us a lot about the priorities of liberal internationalism now, and Kant's contrasting objectives for practical philosophy and humanity ingeneral. In all European countries, the eighteenth century was characterised by efforts to improve the vernaculars. The Transylvanian case study shows how both codified medical language and ordinary language were constructed and enriched by a large number of medical books and brochures. The publication of medical literature in Central European vernacular languages in order to popularise new medical knowledge was a comprehensive programme, designed on the one hand by intellectual, political and religious elites who urged the improvement of the fatherland and (...) the promotion of the common good by perfecting the arts and sciences. On the other hand, the imperial administration’s initiatives affected local forms of medical knowledge and the construction of vernacular languages. In the eighteenth century, the construction of vernacular languages in the Habsburg Monarchy took on a significant political character. However, in the process of building of the scientific and medical vocabulary, the main preoccupation was precision, clarity and accessibility of the neologisms being invented to encompass the medical phenomena being described. In spite of political conflicts among the ‘nations’ living in Transylvania, physicians borrowed words from German, Hungarian and Romanian. Thus they elevated several words used in everyday language to the upper social stratum of language use, leading to the invention of new terms to describe particular medical practices or phenomena. When there are two lines of argument that contradict each other but still end up with the same conclusion, this conclusion is called a floating conclusion. It is an open topic in skeptical defeasible reasoning if floating conclusions ought to be accepted. Inter- estingly, the answer seems to be changing for different examples. In this paper, we propose a solution for explaining the different treatments of the floating conclusion in the various examples from the literature. We collect the examples from (...) the literature, extend them with additional examples and test various hypotheses for explaining the difference by means of the examples. We will argue for a framework that accepts a floating conclusion by default but allows for reasons to deviate from the default in order to reject it. These reasons nicely explain the different underlying patterns of our intuitions. (shrink)

Problems arise when applying the current procedural conceptualization of decision-making capacity to paediatric healthcare: Its emphasis on content-neutrality and rational cognition as well as its implicit assumption that capacity is an ability that resides within a person jeopardizes children’s position in decision-making. The purpose of the paper is to challenge this dominant account of capacity and provide an alternative for how capacity should be understood in paediatric care. First, the influence of developmental psychologist Jean Piaget upon the notion of capacity (...) is discussed, followed by an examination of Vygostky’s contextualist view on children’s development, which emphasizes social interactions and learning for decision-making capacity. In drawing parallels between autonomy and capacity, substantive approaches to relational autonomy are presented that underline the importance of the content of a decision. The authors then provide a relational reconceptualization of capacity that leads the focus away from the individual to include important social others such as parents and physicians. Within this new approach, the outcome of adults’ decision-making processes is accepted as a guiding factor for a good decision for the child. If the child makes a choice that is not approved by adults, the new conceptualization emphasizes mutual exchange and engagement by both parties. (shrink)

Se propone revisar la elaboración del concepto de piñen examinando la relación entre lenguaje y colonialidad, para, de ese modo, subrayar el potencial político y reivindicativo que comporta en la novela del mismo nombre, Piñen (2019). Dicha hipótesis articulará el ejercicio de lectura aquí propuesto, atendiendo principalmente las estrategias narrativas empleadas –servirse de un polilingüismo que rompe estructuras gramaticales– para descentrar el lenguaje de su determinismo colonial. As the pre-eminent Enlightenment philosopher, Kant famously calls on all humans to make up their own minds, independently from the constraints imposed on them by others. Kant's focus, however, is on universal human reason, and he tells us little about what makes us individual persons. In this book, Katharina T. Kraus explores Kant's distinctive account of psychological personhood by unfolding how, according to Kant, we come to know ourselves as such persons. Drawing on Kant's Critical works and on his (...) Lectures and Reflections, Kraus develops the first textually comprehensive and systematically coherent account of our capacity for what Kant calls 'inner experience'. The novel view of self-knowledge and self-formation in Kant that she offers addresses present-day issues in philosophy of mind and will be relevant for contemporary philosophical debates. In an engaging, down-to-earth style Daniela Isac and Charles Reiss give a crystal-clear demonstration of the application of the scientific method in linguistic theory. A realist view of numbers often rests on the following thesis: statements like ‘The number of moons of Jupiter is four’ are identity statements in which the copula is flanked by singular terms whose semantic function consists in referring to a number (henceforth: Identity). On the basis of Identity the realists argue that the assertive use of such statements commits us to numbers. Recently, some anti-realists have disputed this argument. According to them, Identity is false, and, thus, we may deny (...) that the relevant statements commit us to numbers. The present paper argues that the correct linguistic analysis of the relevant number statements supports the anti-realist view that Identity is false. However, as will further be shown, pace the anti-realist, this analysis does not establish that such statements do not commit us to numbers after all. (shrink)

If circumstances were always simple and all arguers were always exclusively concerned with cognitive improvement, arguments would probably always be cooperative. However, we have other goals and there are other arguers, so in practice the default seems to be adversarial argumentation. We naturally inhabit the heuristically helpful but cooperation-inhibiting roles of proponents and opponents. We can, however, opt for more cooperative roles. The resources of virtue argumentation theory are used to explain when proactive cooperation is permissible, advisable, and even mandatory (...) – and also when it is not. (shrink)

Unter den Institutionen des Sendens stellt das Fernsehen mit Sicherheit die über lange Jahrzehnte erfolgreichste dar. Gleichwohl wird angesichts der mit der Digitalisierung einhergehenden, das Senden und die Sendungen weitreichend betreffenden Veränderungen, die das Medium unterläuft, vielerorts und nicht völlig grundlos die Post-Broadcast-Ära ausgerufen. Anhand der Lektüre verschiedener Serien werden diese Veränderungen hier nachvollzogen und untersucht. Das Sendungsformat der Serie erscheint für ein solches Unterfangen besonders geeignet, weil das Senden des Fernsehens zutiefst mit der Serialität und dem Seriellen als Prinzip (...) verknüpft scheint. An den Formen und Veränderungen des Seriellen lassen sich auch die Veränderungen des Fernsehsendens ablesen. Among the many institutions of sending, television certainly represents the most successful one over long decades. Nevertheless, given the changes that the medium incurs in terms of broadcasting and broadcasts as a consequence of digitalisation, many proclaim – and not entirely without reason – the post-broadcast era. This paper studies these changes by way of a reading of different television series. The format of the series seems particularly suitable to this end, since the broadcasting of television seems deeply linked to seriality and the serial as a principle. The changes in television broadcasting can be gleaned from the forms and changes of the serial. (shrink)

Background: Pediatric guidelines recommend that children and adolescents participate in a developmentally appropriate way in end-of-life decision making. Shared decision making in pediatrics is unique because of the triadic relationship of patient, parents, and physician. The involvement of the patient may vary on a continuum from no involvement to being the sole decision maker. However, the effects of child participation have not been thoroughly studied. The aims of this literature review are to identify studies on end-of-life decision making in pediatrics, (...) to explore patient participation, and to assess the effects of such participation. Methods: Five databases—PubMed, PsycInfo, Medline, CINAHL, and Sociological Abstract—were searched for empirical studies on end-of-life decision making in pediatrics. Selected articles fulfilling the criteria were assessed for type of decision, participants’ characteristics, reports on participation of the minor patient, and outcome. Results: Fifty-seven articles on end-of-life decision making in pediatrics were identified. The majority of papers (n = 43, 75%) investigated parents’ and clinicians’ perspectives, while only 14 articles (25%) included perspectives of children and adolescents. Twenty-two articles (39%) reported some details on various forms of children's participation (e.g., receive information, plan care details, consulted before or after a decision was made). Positive (e.g., respect for patient's preferences) and negative (e.g., conflict due to diverging opinions) effects of children's participation in end-of-life decision making were reported. Conclusions: This systematic review highlights the need for research to identify factors that contribute to a favorable participation of minors in decision-making processes, as well as strategies to solve possible conflicts. More research should take into account the dynamics in the triadic process of decision making and emphasize children and adolescents’ perspectives. A better understanding of how to meaningfully involve children and adolescents in end-of-life decision making could facilitate the practice of patient participation in pediatrics. (shrink)

Feminist argumentation theorists have criticized the Dominant Adversarial Model in argumentation, according to which arguers should take proponent and opponent roles and argue against one another. The model is deficient because it creates disadvantages for feminine gendered persons in a way that causes significant epistemic and practical harms. In this paper, I argue that the problem that these critics have pointed out can be generalized: whenever an arguer is given a role in the argument the associated tasks and norms of (...) which she cannot fulfill, she is liable to suffer morally significant harms. One way to react to this problem is by requiring arguers to set up argument structures and allocate roles so that the argument will be reasons-reflective in as balanced a way as possible. However, I argue that this would create to heavy a burden. Arguers would then habitually have to take on roles that require them to divert time and energy away from the goals that they started arguing for and instead serve the goal of ideal reasons-reflectiveness. At least prima facie arguers should be able to legitimately devote their time and energy towards their own goals. This creates a problem: On the one hand, structures that create morally significant harms for some arguers should be avoided—on the other hand, arguers should be able to take argument-roles that allow them to devote themselves to their own argumentative goals. Fulfilling the second requirement for some arguers will often create the morally significant harms for their interlocutors. There are two possible solutions for this problem: first, arguers might be required to reach free, consensual agreements on the structure they will adopt for their argument and the way they will distribute argumentative roles. I reject this option as both fundamentally unfeasible and practically unrealistic, based on arguments developed by theorists like Krabbe and Jacobs. I argue that instead, we should take a liberal view on argument ethics. Arguers should abide by moral side constraints to their role taking. They should feel free to take roles that will allow them to concentrate on their argumentative goals, but only if this does not create a situation in which their interlocutors are pushed into a role that that they cannot effectively play. This paper investigates the process of reasoning through which a judge determines whether a precedent-case gives her a binding reason to follow in her present-case. I review the objections that have been raised against the two main accounts of reasoning by precedent: the rule-account and the analogy-account. I argue that both accounts can be made viable by amending them to meet the objections. Nonetheless, I believe that there is an argument for preferring accounts that integrate analogical reasoning: any account of (...) reasoning by precedent that is descriptively minimally adequate will leave some room for judicial discretion. Discretion should be used under consideration of the best legally relevant arguments for and against a decision. Integrating analogical reasoning helps the judge to bring to her own attention the strongest case for following. Analogical reasoning also eases the recognition of possible reasons for distinguishing. Thereby, it facilitates a more balanced decision-making process. (shrink)

Jahrhunderts. Sie trägt damit neue Aspekte zur Debatte des Materialismus in der Frühen Neuzeit bei. Untersucht werden Texte sogenannter Meisterdenker als auch Zeugnisse derer, die bisher wenig berücksichtigt wurden. Dem Corpus Paracelsicum und der Strömung des Paracelsismus wird besondere Beachtung gezollt. Drei rasterartig umrissene Grundmuster, denen die „Materia prima“-Vorstellungen zugeordnet sind, werden ausführlich (...) vorgestellt und dabei Kontinuitäten sowie Transformationen von vorhandenen Materie-Konzepten festgestellt.​. En la última década, se han producido fuertes reconfiguraciones en la industria editorial argentina. En principio, se puede pensar en tres procesos que coexisten y que marcan tendencias novedosas en la formación y configuración de los campos editoriales nacionales: la concentración de la industria, la irrupción de las tecnologías digitales y la internacionalización. Los tres procesos se articulan de manera transformadora y complementaria. En este contexto, los editores funcionan como intermediarios culturales a partir del fortalecimiento de emprendimientos de nuevo tipo (...) que hacen usos novedosos de las posibilidades de la digitalización de la palabra. El objetivo de este artículo es exponer la problemática de la edición digital en el campo editorial argentino y cómo las tecnologías de la información y comunicación —TICs—, en el marco del capitalismo informacional, generan nuevos editores y modelos de editorial que proponen modalidades digitales de edición. En particular, hemos analizado la emergencia, en 2007, de Teseo, una editorial argentina, desde una perspectiva cualitativa. Por un lado, el abordaje metodológico se vinculó con el análisis de su página web y su catálogo, y se realizaron además dos entrevistas en profundidad con su director, Octavio Kulesz. A través de la indagación por el sentido en que este editor opera como propulsor de procesos de intermediación cultural, profundizaremos en la dirección de estos nuevos procesos culturales. (shrink)

Drawing on Deleuze's early works of the 1960s, this article investigates the ways in which Deleuze challenges our traditional linguistic notion of sense and notion of truth. Using Frege's account of sense and truth, this article presents our common understanding of sense and truth as two separate dimensions of the proposition where sense subsists only in a formal relation to the other. It then goes on to examine the Kantian account, which makes sense the superior transcendental condition of possibility of (...) truth. Although both accounts define sense as merely the form of possibility of truth, a huge divide cuts across a simple formal logic of sense and a transcendental logic: transcendental logic discovered a certain genetic productivity of sense, such that a proposition always has the kind of truth that it merits according to its sense. In pursuit of this genetic productivity of sense, Deleuze applies different models of explanation: a Nietzschean genealogical model of the genetic power of sense, and in The Logic of Sense a structural model combined with elements of Stoic philosophy. This article follows Deleuze in setting up a new and very complex notion of sense, which he radically distinguishes from what he terms ‘signification’, that is, an extrinsic, linguistic or logical, condition of possibility. Rather, sense has to be conceived as both the effect and the intrinsic genetic element of an extra-propositional sense-producing machine. (shrink)

In this paper, we argue that ‘good care’ in residential nursing homes is enacted through different care practices that are either inspired by a ‘professional logic of care’ that aims for justice and non-maleficence in the professional treatment of residents, or by a ‘relational logic of care’, which attends to the relational quality and the meaning of interpersonal connectedness in people’s lives. Rather than favoring one care logic over the other, this paper indicates how important aspects of care are constantly (...) negotiated between different care practices. Based on the intricate everyday negotiations observed during an ethnographic field study at an elderly nursing home in Germany, the paper puts forth the argument that care is always a matter of tinkering with different, sometimes competing ‘goods’. This tinkering process, which unfolds through ‘intuitive deliberation’, ‘situated assessment’ and ‘affective juggling’ is then theorized along the conceptualization of a ‘practical ethics of care’: an ethics which makes no a priori judgments of what may be considered as good or bad care, but instead calls for momentary judgments that are pliable across changing situations.
